Our client was battered, forcibly restrained, and chased from school grounds into a nearby park by a group of more than 20 students.

Despite those warnings, the school allegedly failed to implement appropriate safeguards, increase supervision, separate the students involved, or otherwise take reasonable measures to protect him.

Can a School Be Liable for a Student Assault?

New York schools are not automatically responsible for every altercation that occurs between students. However, schools have a duty to adequately supervise students in their custody and may be held liable when an injury results from foreseeable conduct that proper supervision could have prevented.

A school negligence claim may arise when school officials:

  • Know or should know that a student is being bullied, threatened, or targeted;
  • Fail to adequately supervise students during dismissal, recess, lunch, transportation, or school activities;
  • Ignore prior complaints or reports of harassment;
  • Fail to separate students involved in an ongoing conflict;

The allegations included that the school failed to:

  • Provide adequate supervision during dismissal;
  • Maintain control over the student body;

  • Intervene before the attack escalated;
  • Prevent the students from chasing the child away from school grounds; and

Dismissal is a particularly important period for student supervision. Large numbers of students are leaving classrooms at the same time, conflicts may continue outside the building, and students can quickly move beyond the immediate control of school personnel.

Schools must have appropriate procedures, staffing, and security measures in place to protect students during this transition.

Physical Injuries Caused by the Assault

The student sustained significant physical injuries during the attack, including traumatic hematomas and pain affecting his face, neck, and back.

He required an emergency hospital evaluation following the incident.

Although the visible injuries were serious, the psychological consequences became even more profound.

PTSD and the Psychological Effects of School Violence

After the assault, the student developed severe symptoms associated with Acute Stress Disorder and Post-Traumatic Stress Disorder, commonly known as PTSD.

His symptoms included:

  • Depression;
  • Severe anxiety;
  • Difficulty sleeping;
  • Persistent fear;
  • Emotional withdrawal;
  • Fear of leaving his bedroom; and
  • Difficulty returning to a normal routine.

The trauma caused the student to feel unsafe even outside the school environment. He required comprehensive psychiatric treatment, ongoing psychotherapy, and daily medication to address the emotional effects of the attack.

Psychological injuries are real injuries. A child who experiences a violent assault may continue to suffer long after bruises and other physical injuries have healed.

In a school assault case, compensation may therefore include damages for emotional distress, PTSD, psychiatric treatment, therapy, medication, pain and suffering, and the future effects of the trauma.
