FIGHTING FOR INJURED WORKERS

The insurance carrier already has a strategy. You need one too.

When you are injured on the job in New York, you are not just trying to recover physically — you are navigating a complex workers’ compensation system designed to limit what gets paid and when.

Insurance carriers, employers, and third-party administrators often move quickly to control the claim, minimize your injuries, or deny benefits altogether.

Workers’ compensation claims are not just paperwork. They are disputes between injured workers and insurance carriers, between employees and insurance-selected doctors, and between families and a system built to limit payouts.

At HaddLegal, we represent injured workers across every industry — construction, transit, healthcare, delivery, warehouse, hospitality, and building services. We handle every stage of the claim, and we look beyond workers’ comp: if a property owner, contractor, driver, or manufacturer caused your injury, you may also have a third-party lawsuit that can recover pain and suffering and full lost wages.

You focus on your recovery. We handle the fight. Call today for a free consultation.

Workers' Comp Cases We Handle Across New York

No two workplace injuries are the same, and each type of claim requires a different strategy. Below are the most common types of workers’ compensation cases we handle throughout New York:

Construction Site Injuries

Construction workers are entitled to workers’ comp — and often much more. When a fall, falling object, or unsafe site condition causes the injury, New York Labor Law may allow a separate lawsuit against the owner and general contractor. Working with a lawyer in Manhattan or elsewhere across New York who handles both is critical.

Work-Related Car & Truck Crashes

Delivery drivers, sales reps, and anyone injured while driving for work are generally covered by workers’ comp. A separate claim against the at-fault driver may also be available. Working with a lawyer who handles car accident and workers’ comp claims together is critical to your recovery.

Back, Neck & Spinal Injuries

Herniated discs, spinal fusions, and nerve damage are among the most disputed claims. Carriers use their own medical examiners to argue you can return to work. Working with a workers’ comp lawyer in Brooklyn or elsewhere across New York is critical to protecting your benefits.

Shoulder, Knee & Joint Injuries

Rotator cuff tears, meniscus tears, and joint replacements can entitle you to a schedule loss of use award for permanent loss of function — in addition to weekly benefits. Working with a workers’ comp lawyer in Queens or elsewhere across New York is critical to maximizing it.

Repetitive Stress & Occupational Illness

Carpal tunnel, cumulative back injuries, hearing loss, and illnesses from toxic exposure develop over time. These claims have their own deadline rules and require strong medical proof. Working with a workers’ comp lawyer in the Bronx or elsewhere across New York is critical to establishing your claim.

Denied & Disputed Claims

Denials, benefit cutoffs, and treatment refusals are decided at hearings before a Workers’ Compensation Law Judge, with strict appeal deadlines. Working with a workers’ comp lawyer on Long Island or elsewhere across New York is critical to enforcing your rights.

IN THE FIRST 24 HOURS

WHAT TO DO AFTER A WORK INJURY IN NEW YORK

What you do in the hours and days after a workplace injury directly impacts your benefits.

1. Get medical treatment immediately

Tell the provider the injury happened at work and give your employer’s information. Treat with a Workers’ Compensation Board-authorized provider.

2. Notify your employer in writing

New York generally requires written notice to your employer within 30 days of the accident. Keep a copy of what you submit.

3. File your claim with the Board

File Form C-3 with the Workers’ Compensation Board. You generally have 2 years, but filing right away prevents delays in benefits.

4. Keep records and identify witnesses

Save pay stubs, medical records, and correspondence, and note the names of coworkers who saw the accident or unsafe conditions.

5. Contact a workers’ comp lawyer

A lawyer can protect your benefits and identify any third-party lawsuit — such as against a property owner, contractor, or driver.

NO COST. NO RISK. JUST JUSTICE.

How Workers' Comp Works Under New York Law

Understanding the workers’ comp system is critical, because insurance carriers rely on confusion to limit benefits.

WCL §§ 18 & 28

Report and file on time

Strict deadlines protect your right to benefits. In most cases you must:

  • Give your employer written notice within 30 days
  • File your claim with the Board within 2 years

WCL §§ 13 & 15

Benefits regardless of fault

Workers’ compensation pays benefits regardless of who was at fault, including:

  • Medical treatment related to the injury
  • Weekly cash benefits based on your average wage
  • Schedule loss of use awards for permanent injuries

WCL § 120

No retaliation

It is illegal for your employer to fire, discipline, or retaliate against you because you filed a workers’ compensation claim.

WCL § 29

Third-party lawsuits

Workers’ comp usually bars suing your employer — but not third parties such as property owners, contractors, drivers, or manufacturers.

CASE VALUE

What Is Your New York Workers' Comp Claim Worth?

There is no “average” workers’ compensation claim. Every injury and every work history is different.

Your benefits may include:

  • Weekly cash benefits while you are out of work
  • Medical treatment, surgery, and therapy
  • Schedule loss of use awards for permanent injuries
  • Lump-sum settlements when appropriate
  • Death benefits for surviving family members

The truth is this:

Your claim is worth what you can prove—and how aggressively it is litigated.

LEVERAGE

Why Hiring the Right New York Workers' Comp Lawyer Changes Everything

Insurance carriers keep internal data on law firms. They know which lawyers accept the first offer, which lawyers skip hearings, and which lawyers are willing to fight. That directly impacts how your claim is handled.

At HaddLegal, we prepare every claim for litigation before the Board — and we evaluate every case for a third-party lawsuit that can recover what workers’ comp does not. That is how leverage is created.

Why Hire HaddLegal?

✓We represent injured workers — not employers or insurance carriers

✓You get direct access to your attorney

✓We build aggressive, trial-ready cases

✓We look for third-party claims beyond workers’ comp

✓You pay nothing unless we win

We are not here to process your case. We are here to win it.

THE REALITY

Why Most Injured Workers Get Underpaid

Insurance carriers do not evaluate workers’ comp claims fairly. They evaluate risk.

They often try to:

  • Minimize the seriousness of your injuries
  • Dispute that your injury is work-related
  • Delay approval of medical treatment
  • Cut off or reduce your wage benefits
  • Force you back to work before you are ready
  • Push you toward a low settlement

If you do not have a lawyer, you are at a disadvantage from day one.

If you have the wrong lawyer, you are still at a disadvantage.

You are not just dealing with a work injury.

You are dealing with insurance carriers, employers, medical examiners, and a system designed to limit payouts. We fight back. Call now for a free consultation.

MEET YOUR ATTORNEY

Why Hire HaddLegal as Your Workers’ Compensation Attorney?

Car accident attorney

When you are injured on the job in New York, you are not just trying to recover physically. You are navigating a complex workers’ compensation system designed to limit what gets paid and when.

I represent injured workers on the other side of that system.

As a New York workers’ compensation attorney, I represent employees across all industries who have been hurt in the course of their employment. My practice includes claims involving:

  • Workplace accidents and traumatic injuries
  • Repetitive stress and occupational injuries
  • Construction site injuries covered under workers’ compensation
  • Back, neck, and spinal injuries
  • Shoulder, knee, and joint injuries
  • Work-related illnesses and exposure claims

Every Stage of Your Workers’ Compensation Claim

I handle every stage of the New York workers’ compensation process, including:

• Filing and establishing your claim
• Securing wage replacement benefits (lost wages)
• Obtaining authorization for medical treatment
• Litigating disputed claims before the Workers’ Compensation Board
• Appealing denials or reductions in benefits

Workers’ compensation law exists to protect employees, but insurance companies routinely attempt to limit that protection. If your claim is being delayed, denied, or undervalued, I take immediate action to enforce your rights. And when a construction accident, vehicle crash, or defective machine caused your injury, I pursue the third-party case too. If a worker is killed on the job, surviving family members may be entitled to death benefits and a wrongful death claim.

You focus on your recovery. I handle the fight.

Workers’ Compensation FAQs

How long do I have to report a work injury in New York?

+

You should give your employer written notice within 30 days of the accident, and you generally must file your claim with the Workers’ Compensation Board within 2 years. Occupational illnesses have special timing rules based on when you knew or should have known the condition was work-related.

Can I be fired for filing a workers’ compensation claim?

+

No. New York Workers’ Compensation Law § 120 makes it illegal for an employer to fire, discipline, or retaliate against an employee for filing or pursuing a claim.

Can I sue my employer for a work injury?

+

In most cases, no — workers’ compensation is the exclusive remedy against your employer. But you can often sue third parties whose negligence caused the injury, such as a property owner, general contractor, driver, or equipment manufacturer. For construction workers, New York Labor Law provides especially strong protections.

Does workers’ comp pay for pain and suffering?

+

No. Workers’ compensation covers medical treatment and a portion of lost wages, plus awards for permanent injuries. Pain and suffering can only be recovered through a separate third-party lawsuit when another party is responsible.

Can I choose my own doctor?

+

In most cases, yes — you can treat with any provider authorized by the Workers’ Compensation Board. If your employer participates in a certified preferred provider organization, you may need to start treatment within that network.

Can I get workers’ comp if I am not a U.S. citizen?

+

Yes. Injured workers in New York are generally entitled to workers’ compensation benefits regardless of immigration status.

How much does a workers’ compensation lawyer cost?

+

There are no upfront fees. In New York, attorney’s fees in workers’ compensation cases must be approved by the Workers’ Compensation Board and are generally paid out of your award — not out of your pocket.
