Who pays after an Uber or Lyft crash in New York City? If you were a passenger, your medical bills and lost wages are paid first by New York no-fault (PIP) benefits through the rideshare vehicle’s own policy — regardless of who caused the crash. To recover pain and suffering on top of that, you must sue the at-fault driver and prove a “serious injury” under Insurance Law § 5102(d). Because Uber and Lyft vehicles in NYC are TLC-licensed, the liability policy is usually $100,000 per person / $300,000 per accident — not the $1.25 million that applies elsewhere in New York State.
NEW YORK NO-FAULT & THE 30-DAY DEADLINE THAT ENDS CLAIMS
New York is a no-fault state. As an Uber or Lyft passenger, your medical treatment, prescriptions, and a portion of your lost earnings are paid by the rideshare vehicle’s own no-fault carrier, regardless of who caused the crash. You do not have to prove fault to get treatment paid.
You must file the no-fault application (Form NF-2) within 30 days of the accident. Miss it and the carrier can deny your benefits outright. This is the single most common way a strong rideshare case gets crippled in the first month — before anyone has even talked about a lawsuit.
The “Serious Injury” Threshold
No-fault pays your bills, but it does not pay for pain and suffering. To recover that, New York Insurance Law § 5102(d) requires you to meet the serious injury threshold — categories including fracture, significant limitation of use of a body function or system, permanent consequential limitation, or a medically determined injury preventing you from performing substantially all of your usual daily activities for 90 of the first 180 days after the crash.
Defense firms move for summary judgment on threshold in nearly every soft-tissue case. Whether your file survives that motion is largely determined by how your treatment and imaging are documented in the first ninety days. That is work that starts immediately, not after the settlement talks stall.
Rideshare Insurance in NYC Is Not What You Read Online
New York State’s Transportation Network Company law (Vehicle & Traffic Law Article 44-B) requires Uber and Lyft to carry $1.25 million in liability coverage once a driver accepts a trip. That statute is exempted inside New York City. In the five boroughs, every Uber and Lyft vehicle must instead be licensed by the NYC Taxi & Limousine Commission and insured under TLC’s for-hire vehicle rules — substantially lower limits.
The practical consequence: the same crash produces a very different recovery ceiling depending on which side of the city line it happened on. Firms that copy national rideshare content onto a New York page miss this entirely — and so do the adjusters banking on you not knowing it.
| Coverage | Inside NYC (TLC rules) | Rest of New York State (VTL Art. 44-B) |
|---|---|---|
| Liability minimum | $100,000 per person / $300,000 per accident | $75k/$150k when app is on; $1.25M once a trip is accepted |
| No-fault (PIP) | $100,000 per person (was $200,000 before 3/1/2026) | $50,000 per person |
| SUM (underinsured motorist) | Not required for TLC vehicles | $1.25M during an accepted trip |
| Daños a la propiedad | $10,000 | $25,000 |
⚠ If your crash happened before March 1, 2026 ⚠
TLC required $200,000 in no-fault benefits — double today’s limit — until the rule change took effect. If you were injured in a TLC-licensed Uber, Lyft, or livery vehicle before that date, the higher PIP limit still governs your claim. Adjusters have been applying the new number to old accidents. Have your date of loss checked.
THE FOUR APP PHASES - AND WHY INSURERS FIGHT OVER THEM
Which policy responds depends entirely on what the driver’s app was doing at the moment of impact. Carriers dispute this constantly, because the phase determines whether they owe you or someone else does.
PHASE 0
App Off
Driver is off duty. Their personal or TLC policy responds. No platform coverage applies.
PHASE 1
App On, Waiting
Logged in, no ride accepted. Contingent coverage — the phase insurers most often try to claim you were in.
PHASE 2
En Route to Pickup
Trip accepted, driving to the rider. Full commercial coverage attaches; excess platform layers may apply.
PHASE 3
Passenger On Board
Highest available coverage. Uber and Lyft may carry excess layers above the TLC minimum for prearranged trips.
The app’s own trip data settles this — and it does not stay available forever. Preserving Uber’s or Lyft’s electronic trip record early is often the difference between a disputed phase and a documented one. Cases like these frequently involve the same contested-fault dynamics as intersection and T-bone collisions y rear-end crashes.
WHO CAN BE HELD LIABLE
Rideshare claims rarely have a single defendant. Under Vehicle & Traffic Law § 388, the owner of a vehicle is vicariously liable for the negligence of anyone operating it with permission — which matters enormously when the driver does not own the car, as is common with TLC fleet and rental arrangements.
The rideshare driver
Speeding, distraction, unsafe pickups, fatigue.
The vehicle’s owner or fleet
Vicariously liable under VTL § 388 even without personal fault.
Another negligent motorist
Opens a second policy layer, and often the larger one.
The TLC base or platform’s carrier
Primary and excess layers, depending on trip phase.
The City or a municipal entity
Roadway defects or a municipal vehicle — triggers a 90-day Notice of Claim.
Your own SUM coverage
Because SUM is not mandated for NYC FHVs, your own policy may be the excess layer.

WHAT YOU CAN RECOVER
Recovery in a New York rideshare case comes from two separate tracks that operate on different timelines.
TRACK 1 · NO-FAULT
Medical treatment and related expenses. Lost earnings (statutory monthly cap). Reasonable and necessary household services. Paid without proving fault, but subject to the 30-day filing rule and carrier IMEs.
TRACK 2 · LIABILITY CLAIM
Pain and suffering. Loss of enjoyment of life. Future medical care and surgery. Lost earning capacity beyond no-fault limits. Requires meeting the § 5102(d) serious injury threshold.
Every case turns on its own facts. No attorney can promise a result, and prior outcomes do not guarantee future ones.
DEADLINES THAT CAN END YOUR CASE
| Deadline | Applies To | Time Limit |
|---|---|---|
| No-fault application (NF-2) | Every injured passenger, pedestrian, or driver | 30 días |
| No-fault medical bill submission | Providers billing the carrier | 45 days from treatment |
| Aviso de demanda | Claims against the City, MTA, or other public entity | 90 días |
| Personal injury lawsuit | Most negligence claims (CPLR § 214) | 3 years |
| Wrongful death action | Estate of a person killed in the crash | 2 years from date of death |
What To Do After an Uber or Lyft Crash in New York
- Call 911 and get an MV-104 police report. Rideshare carriers dispute unreported crashes aggressively.
- Screenshot the trip in your app — driver name, plate, trip time, route, and receipt. This is the phase evidence.
- Get evaluated the same day. Gaps in treatment are the first thing defense counsel argues on threshold.
- Photograph the vehicle’s TLC plate and diamond decal, both vehicles’ damage, and the scene.
- File your NF-2 within 30 days. Do not assume anyone else is doing this for you.
- Give no recorded statement to any carrier before speaking with counsel.
- Do not accept an early offer. Pre-surgical offers on disc injuries are routinely a fraction of case value.
Where We Handle Rideshare Cases
HaddLegal is based in Manhattan and litigates across all five boroughs and Long Island. Venue matters: a case in Kings County Supreme moves differently than the same case in Richmond County, and knowing the local bench and the local carriers is part of the strategy.
Uber & Lyft Accident FAQs
¿Mi caso irá a juicio?
