Tell us what happened. We call back fast, and there is no cost or obligation.
The Bronx runs on roads that were built for a different century. The Cross Bronx cuts the borough in half and backs up at almost any hour. The Deegan and the Bruckner move freight day and night. The Grand Concourse is eleven lanes of local, express and service traffic with pedestrians crossing all of it. Crashes here are rarely simple fender benders.
We handle Bronx car accident cases from the first call through trial. You deal with the lawyer working your file, not a rotating desk of case managers.

WHAT DECIDES A BRONX CRASH CASE
Two things decide a Bronx car crash case early, and neither one is how badly you were hurt. The first is which insurance policy pays, because a livery cab, an MTA bus and a private driver all bring different coverage. The second is which deadline runs first, and in the Bronx that is often a 90-day notice deadline nobody warned you about.
Below is how these cases actually work here, road by road and deadline by deadline, so you know what the adjuster already knows.
WHERE BRONX CASES ARE HEARD
CPLR § 503 · BRONX COUNTY SUPREME COURT
Bronx car accident suits are filed at 851 Grand Concourse. Venue generally follows where the parties live, so a Bronx resident hurt in Westchester or Manhattan can often still file here, and a driver from out of the county can end up defending here because your address puts the case in the Bronx.
Defense firms move to shift Bronx cases out of the county as a matter of routine, and a demand to change venue comes early in the case. We cover that fight in depth on our Bronx personal injury lawyer page.
THE COURTHOUSE
BRONX COUNTY SUPREME COURT
851 Grand Concourse
Bronx, NY 10451
Civil term. 4, B and D trains to 161 St–Yankee Stadium.
Smaller claims are heard in the Civil Court of the City of New York, Bronx County, in the same building.
THE ROADS BEHIND BRONX CRASHES
EXPRESSWAYS · PARKWAYS · BOULEVARDS
Every corridor in the Bronx has its own crash pattern, and knowing it tells us where the evidence is before the carrier gets there.
Cross Bronx Expressway
I-95 · GEORGE WASHINGTON BRIDGE TO THE THROGS NECK
One of the most congested stretches of highway in the country, with truck traffic, short merges and constant stop-and-go. Rear-end chain reactions and lane-change sideswipes are the daily pattern, and the crash is usually caught on somebody’s dashcam.
Major Deegan Expressway
I-87 · MOTT HAVEN TO RIVERDALE
Freight running to and from Westchester and upstate, plus Yankee Stadium traffic pouring on and off near 161st Street. Game days and rush hour stack up into the same crash profile: fast traffic braking hard with no shoulder to escape to.
Bruckner Expressway and Boulevard
I-278 AND I-95 · SOUTH AND EAST BRONX
The expressway above and a wide, fast boulevard below, connected by service roads and turns that surprise drivers who do not know them. Merge crashes up top, intersection crashes down below.
Grand Concourse
MOTT HAVEN TO MOSHOLU PARKWAY
The borough’s main boulevard, with express lanes, service lanes and pedestrians crossing all of them. The city made much of it an Arterial Slow Zone after years of serious crashes, and turning conflicts still drive the cases we see.
Fordham Road and Webster Avenue
CENTRAL BRONX COMMERCIAL SPINE
Buses, delivery trucks, double-parking and heavy foot traffic in the same few lanes. Failure-to-yield and left-turn crashes under VTL § 1141 are the recurring fact pattern.
Hutchinson River Parkway
PELHAM BAY TO THE WESTCHESTER LINE
Narrow lanes, tight curves and low bridges. Commercial vehicles are banned from New York parkways, so a truck involved in a crash on the Hutch has a liability problem before anyone looks at the impact.
WHY THE ROAD MATTERS
Where the crash happened decides who maintains the road, which agency holds the camera footage, and whether a public entity is in the case at all. State DOT runs the expressways, NYC DOT runs the boulevards, and the MTA runs the buses on them. Each keeps its own records, each has its own deadline, and most video is overwritten within days.
We also handle crashes on White Plains Road, Southern Boulevard, Boston Road, Third Avenue, Westchester Avenue, Pelham Parkway, Mosholu Parkway, East Tremont Avenue, Jerome Avenue and the approaches to the Throgs Neck and Whitestone bridges.
BRONX CRASHES WITH EXTRA RULES
WHO HIT YOU CHANGES THE CASE
Plenty of Bronx crashes involve more than two private drivers. When the other vehicle is a city bus, a livery cab or a tractor-trailer, the insurance, the deadlines and the list of defendants all change.
MTA Buses and City Vehicles
A crash with a Bx bus, a sanitation truck or an NYPD car is a claim against a public entity. That means a Notice of Claim, generally within 90 days, and a hearing under oath before suit.
Livery Cabs, Uber and Lyft
The Bronx runs on for-hire vehicles, and they are TLC-licensed, which puts them under different insurance rules than a private car. See our Uber and Lyft accident page.
Trucks on the Cross Bronx and Deegan
Interstate freight and the Hunts Point market move through the borough around the clock. Truck accident cases need driver logs, ELD data and maintenance records preserved before the carrier recycles them.
Hit-and-Run and Uninsured Drivers
If the driver fled or had no coverage, your own policy or MVAIC may still pay, but the crash generally has to be reported to police within 24 hours. More on hit-and-run claims.
Crashes Caused by the Road Itself
Potholes, missing signs, broken signals and unmarked construction on a City street can put NYC DOT in the case, which brings its own notice rules and its own proof of prior complaints.
Pedestrians, Cyclists and Delivery Riders
The Concourse, Fordham Road and Southern Boulevard carry heavy foot and bike traffic. See our pedestrian accident and e-bike and bicycle accident pages.
DEADLINES THAT CAN END A CLAIM
FASTEST CLOCKS FIRST
Most people have heard they get three years to sue. That is true, and it matters far less than you would think. The deadlines that sink Bronx cases run in days, and they start the day of the crash.
NO-FAULT AND THE SERIOUS INJURY RULE
INSURANCE LAW ART. 51 · § 5102(d)
New York is a no-fault state. After a Bronx crash, your own policy pays medical bills and part of your lost wages, up to $50,000 in basic economic loss, no matter who caused it. Motorcyclists are the exception and get no no-fault benefits at all, which is why a motorcycle accident claim is built differently.
No-fault pays nothing for pain and suffering. To recover that from the other driver, you have to meet the serious injury threshold under Insurance Law § 5102(d). The categories that come up most:
- A fracture
- Significant disfigurement, including scarring
- Permanent consequential limitation of a body organ or member
- Significant limitation of use of a body function or system
- An injury that kept you from substantially all of your normal daily activities for 90 of the first 180 days
Carriers fight this harder than anything else in a car case. We meet it with MRI findings, treating-doctor narratives and measured range-of-motion testing, because that is what the courts weigh.
The traffic rules that decide fault
VTL § 1129
REAR-END CRASHES
The driver in back has to keep a safe distance. New York treats a rear-end hit as presumed negligence by that driver, so “you stopped short” rarely carries the day on the Cross Bronx. More on our rear-end collision page.
VTL § 1141
LEFT TURNS
A driver turning left must yield to oncoming traffic. It is the rule behind most intersection and T-bone cases on the Concourse and Fordham Road.
CPLR § 1411
SHARED FAULT
Even if you were partly at fault, you can still recover. Your award is reduced by your share, which is exactly why adjusters work so hard to pin a percentage on you.
WHAT TO DO AFTER A BRONX CAR ACCIDENT
THE FIRST 30 DAYS
01
Call 911 and get the report number
Ask the responding officers for the precinct and the report number before you leave. If anyone was hurt, New York also requires a DMV report (MV-104) within 10 days.
02
Photograph everything
Both vehicles, the plates, the street signs, the signal, skid marks and your injuries. Note the bodegas, buses and doorbell cameras nearby, because that footage is gone in days.
03
Get treated the same day or the next
Neck, back and head injuries often surface late. A gap in treatment is the first thing an adjuster points at.
04
File for no-fault within 30 days
The application goes to the insurer of the car you were in, or the car that hit you if you were walking or riding.
05
Say nothing on the record
You do not owe the other driver’s insurer a recorded statement, and do not sign a release or a broad medical authorization before a lawyer reads it.
WHAT COMPENSATION COVERS
ECONOMIC · NON-ECONOMIC · FAMILY
No honest lawyer quotes a number over the phone. Value comes down to liability, the coverage available, the medical proof and how the injury has changed your life. These are the categories we build.
ECONOMIC
What the crash cost you
- Past and future medical care
- Surgery, therapy and rehab
- Lost wages beyond no-fault
- Loss of future earning capacity
- Home care and help around the house
NON-ECONOMIC
What the crash took from you
- Past and future pain and suffering
- Loss of enjoyment of life
- Permanent injury and disability
- Scarring and disfigurement
FAMILY AND DEATH CLAIMS
What the family lost
- A spouse’s claim for loss of services
- Pecuniary loss in a wrongful death case
- Conscious pain and suffering before death
- Funeral and medical expenses
Prior results do not guarantee a similar outcome. Every case depends on its own facts.

FREQUENTLY ASKED QUESTIONS
How long do I have to sue after a Bronx car accident?
Against a private driver, generally three years from the crash under CPLR § 214(5). If a City vehicle, MTA bus or City roadway is involved, a Notice of Claim is generally due within 90 days and suit within one year and 90 days. Your no-fault application is generally due within 30 days, so the first deadline is usually the one people miss.
Where will my Bronx car accident case be filed?
Bronx County Supreme Court at 851 Grand Concourse. Venue under CPLR § 503 turns largely on where the parties live, so a Bronx resident hurt outside the borough may still be able to file here.
Can the defense move my case out of the Bronx?
They can try, and they usually do. A demand to change venue as of right generally has to be served with or before the answer, which is one reason the venue question gets decided in the first weeks of a case and not later.
The other driver says I stopped short. Am I at fault for a rear-end crash?
Usually not. Under VTL § 1129 the following driver must keep a safe distance, and New York treats a rear-end collision as presumptive negligence by the rear driver. The presumption can be rebutted, but stop-and-go traffic on the Cross Bronx is rarely enough on its own.
What if the driver who hit me took off or had no insurance?
You may still recover through the uninsured motorist coverage on your own policy, or through MVAIC if there is no policy at all. The crash generally has to be reported to police within 24 hours, so this is a case to bring to a lawyer immediately.
Who pays my medical bills while the case is pending?
Your own no-fault carrier pays medical bills and a portion of lost wages up to $50,000 in basic economic loss, regardless of fault. It pays nothing for pain and suffering. That comes from the at-fault driver once the serious injury threshold under Insurance Law § 5102(d) is met.
I was hurt on an MTA bus or hit by one. Does that change anything?
Yes. A claim against the MTA or the City requires a Notice of Claim, generally within 90 days, and a hearing under oath may be demanded before suit. The deadline is short enough that waiting to see how you feel can end the claim.
What does it cost to hire HaddLegal for a Bronx car accident?
Nothing up front. We handle car accident cases on a contingency fee basis, so there is no attorney fee unless we recover money for you.
